Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you") and Rupenet Technologies Pvt. Ltd. ("BlueSentinel", "we", "us") governing your access to and use of the BlueSentinel Data Loss Prevention platform, including the central server software, DLP agent, Chrome extension, documentation, and any related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you are accepting on behalf of an organization, you represent that you have the authority to bind that organization.
2. Description of Service
BlueSentinel is an enterprise Data Loss Prevention (DLP) platform offered as a cloud-managed SaaS and optional self-hosted solution, that helps organizations prevent unauthorized data exfiltration from endpoint devices. The Service includes:
- DLP Agent software for Windows and macOS endpoints
- Central server software for policy management and monitoring
- Chrome browser extension for web-based data protection
- Admin dashboard for device, policy, and alert management
- REST API for programmatic access
- Technical documentation and support
3. License Grant
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Access and use the BlueSentinel platform (SaaS or self-hosted) and install agents on your endpoints
- Access and use the admin dashboard and API for your internal business purposes
- Deploy the DLP agent on endpoints owned or managed by your organization
This license does not include the right to sublicense, resell, distribute, modify, reverse engineer, decompile, or disassemble the software, except as expressly permitted under applicable law.
4. Customer Responsibilities
- Lawful Use: You shall use BlueSentinel only in compliance with all applicable laws, regulations, and third-party rights, including labor laws, employee monitoring regulations, and data protection legislation.
- Employee Notification: You are solely responsible for providing appropriate notice to your employees, contractors, and end users about the deployment of DLP monitoring software on their devices, as required by applicable law.
- Consent Obligations: Where required by law, you must obtain necessary consents from individuals whose devices are monitored by BlueSentinel.
- Infrastructure: You are responsible for provisioning, maintaining, and securing the server infrastructure on which BlueSentinel is deployed.
- Data Security: You are responsible for the security of your deployment, including database credentials, TLS certificates, admin passwords, and API keys.
- Account Security: You shall maintain the confidentiality of your admin credentials and are responsible for all activities under your account.
5. Data Ownership and Processing
You own your data. Period.
- All data collected by the DLP Agent (alerts, device information, recovery keys, policies) is stored on your servers and remains your property.
- For SaaS customers, BlueSentinel hosts tenant data on secure, isolated Indian servers with strict access controls. For self-hosted Enterprise customers, BlueSentinel does not access or receive any data from your deployment.
- You are the Data Controller for all personal data processed through your BlueSentinel deployment.
- You are responsible for complying with applicable data protection laws (GDPR, DPDP Act, CCPA, etc.) with respect to the data collected by the DLP Agent on your endpoints.
6. Payment Terms
- Fees are as specified in the applicable plan or order form
- All fees are exclusive of taxes unless stated otherwise
- Payment is due within 30 days of invoice date unless agreed otherwise
- Late payments may accrue interest at 1.5% per month or the maximum rate permitted by law
- We reserve the right to suspend access for accounts with payments overdue by more than 30 days
7. Service Level and Support
Support levels vary by plan. See our Service Level Agreement (SLA) for specific commitments. BlueSentinel provides the software on an "as-is" basis. For SaaS customers, uptime commitments are defined in the SLA. For self-hosted deployments, we are not responsible for uptime, availability, or performance of your infrastructure.
8. Intellectual Property
BlueSentinel and its licensors retain all right, title, and interest in the Service, including all software, documentation, APIs, trademarks, trade secrets, and intellectual property. Nothing in these Terms transfers ownership of any intellectual property to you.
9. Restrictions
You shall not:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the software
- Sublicense, resell, lease, or distribute the Service to third parties without written authorization
- Remove or modify any proprietary notices, labels, or marks in the software
- Use the Service to monitor individuals without proper legal authority or required consent
- Attempt to circumvent licensing restrictions or device limits
- Use the Service in a way that infringes the rights of any third party
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
BlueSentinel does not warrant that the Service will be uninterrupted, error-free, or completely secure. No software can guarantee 100% prevention of all data loss. BlueSentinel is a defense-in-depth tool designed to significantly reduce the risk of data exfiltration.
11. Limitation of Liability
To the maximum extent permitted by law, BlueSentinel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Service.
BlueSentinel's total aggregate liability for all claims arising out of these Terms shall not exceed the total fees paid by you in the twelve (12) months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless BlueSentinel, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law or third-party rights
- Your failure to provide required notice or obtain required consent from monitored individuals
13. Termination
- Either party may terminate with 30 days' written notice
- We may terminate immediately for material breach, including non-payment, unlawful use, or violation of licensing terms
- Upon termination, your license to use the Service ceases immediately
- You retain full ownership and access to all data on your For SaaS, your data will be exported and deleted within 90 days. For self-hosted, your data remains on your servers
- Sections on intellectual property, limitation of liability, indemnification, and governing law survive termination
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in [City], India. Before initiating litigation, both parties agree to attempt resolution through good-faith negotiation for a period of 30 days.
15. Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or notice on our website at least 30 days before taking effect. Continued use of the Service after modifications constitutes acceptance of the updated Terms.
